Who we are and what this is

Affiliate Opportunity Finder is a software tool produced and sold by NicheLabsAI, a trading name of Paul Costelo, based in Darlington, England, United Kingdom (“we”, “us”, “our”).

By purchasing or using Affiliate Opportunity Finder (the “Tool”), you (“you”, “the user”) agree to be bound by these Terms of Service. If you do not agree, do not purchase or use the Tool.

The Tool is delivered as a standalone HTML file. It runs in your web browser and connects to Anthropic’s API using an API key that you supply. We do not host the Tool on your behalf and we do not process your API calls.

Licence and permitted use

Upon purchase, we grant you a personal, non-exclusive, non-transferable licence to use the Tool for your own business purposes, subject to the tier you purchased:

• Tier 1: Personal use, one niche profile, 50 AI scans per month.
• Tier 2: Personal use, up to three niche profiles, unlimited AI scans.
• Tier 3: Agency and white-label use, up to 50 profiles, unlimited scans, right to rebrand the Tool under your own name and sell access to it to your own customers. You may not resell the white-label rights themselves.

All tiers include the right to use the Tool for commercial purposes — using its outputs to support your own affiliate marketing activity.

What you may not do

You may not, under any circumstances:

• Resell, sublicence, or share your copy of the Tool with other individuals (except as permitted under Tier 3 white-label rights).
• Remove, alter, or obscure any copyright notices or branding from the Tool (except as permitted under Tier 3 white-label rights).
• Use the Tool to generate content that is deceptive, fraudulent, or that violates the terms of service of any platform where you post it.
• Use the Tool to generate spam, phishing content, or any content designed to mislead or harm consumers.
• Reverse engineer, decompile, or modify the Tool for purposes of creating a competing product.
• Claim that the Tool was created by you (except under valid Tier 3 white-label arrangements).
• Resell the white-label rights included in Tier 3 to other parties.

Your Anthropic API key

The Tool uses the Claude AI API provided by Anthropic, PBC. To use the Tool, you must obtain your own API key from Anthropic at console.anthropic.com.

Your API key is stored locally in your browser. It is sent directly to Anthropic’s servers when you use the Tool’s AI features. We do not have access to your API key, and we do not log, store, or transmit it.

API usage costs are billed directly to you by Anthropic. We have no visibility into your usage and no control over Anthropic’s pricing or service availability. If Anthropic changes its pricing, API terms, or discontinues the service, we are not liable for the impact on your use of the Tool.

You are responsible for keeping your API key secure. Do not share the Tool file if it contains your API key in a saved state.

Payments, refunds and cancellations

All purchases are one-time payments processed through JVZoo or WarriorPlus. There are no recurring charges associated with the Tool itself (API costs are a separate matter between you and Anthropic).

Refund policy: We offer a 30-day money-back guarantee on all tiers. If you are not satisfied with the Tool within 30 days of purchase, contact us at hello@nichelabsai.com and we will process a full refund. Refund requests must be submitted within 30 days of the original purchase date.

We reserve the right to decline refund requests where there is evidence of misuse, policy violation, or where the request is made after the 30-day window.

Refunds are processed through the original payment platform (JVZoo or WarriorPlus) and may take 5–10 business days to appear.

Intellectual property

The Tool, including its code, design, and all associated content, is the intellectual property of NicheLabsAI / Paul Costelo. All rights not explicitly granted to you in these Terms are reserved.

AI-generated outputs produced using the Tool — community lists, post drafts, analysis results — are yours to use for your own commercial purposes. We make no claim to ownership of content generated using your API key.

The NicheLabsAI name, logo, and associated branding are our trademarks. You may not use them without our written permission, except as otherwise permitted in these Terms.

Disclaimer of warranties

The Tool is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that:

• The Tool will be uninterrupted, error-free, or available at all times.
• The AI-generated outputs will be accurate, complete, or suitable for any particular purpose.
• The community suggestions generated by the Tool will be current, accurate, or profitable.
• Using the Tool will result in any particular level of affiliate income or business results.

AI outputs are generated by Anthropic’s Claude model and may contain inaccuracies, outdated information, or content that requires your own judgement and verification before use.

Limitation of liability

To the maximum extent permitted by applicable law, NicheLabsAI and Paul Costelo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Tool — including but not limited to:

• Lost profits or revenue
• Loss of data
• Account suspensions or bans on third-party platforms
• Changes to Anthropic’s API pricing or availability
• Any reliance on AI-generated content

Our total liability to you for any claim arising from your purchase or use of the Tool shall not exceed the amount you paid for your licence.

Third-party platforms

The Tool assists you in identifying and creating content for third-party platforms including Reddit, Facebook, and others. We have no affiliation with these platforms and no control over their rules, algorithms, or enforcement decisions.

You are solely responsible for ensuring your use of the Tool’s outputs complies with the terms of service of any platform where you post content. Platform rules change frequently — it is your responsibility to stay current with them.

Similarly, Anthropic’s API is a third-party service. We are not affiliated with Anthropic beyond being a customer of their API. Changes to Anthropic’s services, pricing, or policies are outside our control.

Changes to this agreement

We reserve the right to update these Terms at any time. Changes will be reflected in an updated “last updated” date at the top of this page. Continued use of the Tool after changes are posted constitutes your acceptance of the revised Terms.

For material changes that affect your rights, we will make reasonable efforts to notify existing customers by email where we hold your contact details.

Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Tool shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are based outside the United Kingdom, you agree that English law governs this agreement regardless of where you are located.
